Terms and conditions

1. Definitions

In these Terms and Conditions, the following words and phrases shall have the meanings assigned to them:(a) "Agreement" means these Terms and Conditions;(b) "Casino" means Elements Casino Brantford;(c) "Gaming Services" refers to all games, betting facilities, equipment, software, hardware, and related services available at or through the casino;(d) "OLG" means the Ontario Lottery and Gaming Corporation; and(e) "User" means any individual who uses the Gaming Services.

2. Acceptance of Terms

By accessing or using the Casino's Gaming Services, User acknowledges that they have read, understood, and agreed to be bound by these Terms and Conditions. If User does not agree with these Terms and Conditions, they shall immediately cease all use of the Casino's Gaming Services.

3. Age Restriction

(a) The minimum age requirement for entering or using the Casino is 19 years.(b) No individual under the age of 19 is permitted to access any part of the casino premises, including its gaming areas, restaurants, lounges, and other facilities.

4. Identification Requirements

User must provide accurate identification upon request by the Casino's staff. User acknowledges that they understand and agree to provide proof of age as required by law.

5. Responsible Gaming Practices

The User acknowledges that:(a) They have the right to exclude themselves from accessing any part of the casino premises;(b) They can set deposit limits, time-out periods, or self-exclusion using responsible gaming tools made available through the Casino's staff; and(c) They will not attempt to circumvent these measures or otherwise compromise their own well-being or that of others.

6. Intellectual Property Rights

All intellectual property rights in relation to the Gaming Services belong exclusively to the Casino and/or its affiliates, suppliers, and third-party providers.

7. Dispute Resolution

(a) Any dispute arising from or related to these Terms and Conditions shall be resolved through a process agreed upon by the parties;(b) The decision of such process is final; and(c) Neither party may bring any claim against each other in respect of its performance under this Agreement after expiry of one (1) year following breach.

8. Governing Law

(a) These Terms and Conditions shall be governed by, construed in accordance with the laws of Ontario;(b) The courts having jurisdiction over the territory where the casino is located have exclusive jurisdiction to hear any dispute arising from or related to these Terms and Conditions;

9. Indemnification

User agrees to indemnify, hold harmless, and defend the Casino, its affiliates, suppliers, third-party providers, officers, directors, employees, agents, contractors, and successors against all claims, losses, demands, liabilities, damages, costs, expenses arising from or related to User's use of the Gaming Services.

10. Termination

The Casino may at any time terminate or suspend these Terms and Conditions by giving written notice to User; provided that:(a) Upon termination or suspension, User shall immediately cease all use of the Casino's Gaming Services;(b) The casino reserves the right to decline entry or revoke privileges without explanation;

11. Changes to These Terms

The Casino may amend, update, revise these Terms and Conditions at any time without prior notice; provided that:(a) Any change to such terms will take effect upon its posting on the casino's website or in writing;(b) Upon becoming effective, all amended terms shall be applicable to User.

12. Entire Agreement

These Terms and Conditions constitute the entire agreement between the parties with respect to the subject matter hereof; provided that:(a) These terms supersede any prior or contemporaneous oral agreements, negotiations, promises, warranties, commitments;(b) Except as otherwise provided herein, there are no representations, undertakings, inducements, promissory statements not included in these Terms and Conditions;

13. Severability

If any term of these Terms and Conditions is held to be invalid or unenforceable by a court of competent jurisdiction:(a) Such provision shall be deemed severable from the remaining terms;(b) The enforceability and validity of all other provisions remains unaffected.

14. Limitation on Liability

The Casino, its affiliates, suppliers, third-party providers, officers, directors, employees, agents, contractors, and successors are not liable for any indirect or consequential damages arising out of or related to User's use of the Gaming Services; provided that:(a) The casino may limit liability in such circumstances;(b) No claim can be made against it after one (1) year following a breach.

15. General Provisions

These Terms and Conditions do not constitute an employment, partnership or other arrangement between parties.The provisions herein are for the benefit of the respective successors-in-interest to each party with whom they entered into this Agreement; provided that:(a) They shall survive termination;(b) Any notice must be in writing;

By accessing or using the Casino's Gaming Services, User acknowledges having read, understood and agreed to these Terms and Conditions.
